Purchase Terms & Conditions
Governing Law, Consent to Jurisdiction and Venue -
This agreement, and any dispute arising out of the purchase or use of our services, shall be governed by the laws of the United States and by the laws of the State of California without regard to its conflicts of laws provisions.
You agree to the jurisdiction and venue in the state and federal courts of Los Angeles County for all purposes in connection with any proceeding which arises out of or relates to this Agreement.
Project and Membership Appointment Cancelations and Rescheduling -
ALL SCHEDULED SERVICES MUST BE CANCELED OR RESCHEDULED 24 HOURS PRIOR TO THE APPOINTMENT TIME TO AVOID A LATE CANCELATION FEE. ALL PROJECTS NOT CANCELED OR RESCHEDULED 24 HOURS PRIOR TO THE APPOINTMENT TIME WILL BE CHARGED THE 25% DEPOSIT AS A LATE CANCELATION FEE AND THE PROJECT DEPOSIT WILL NEED TO BE REPURCHASED TO RESCHEDULE THE PROJECT. KOHOUTEK HANDY HOME MEMBERSHIP APPOINTMENTS NOT CANCELED OR RESCHEDULED 24 HOURS PRIOR TO THE APPOINTMENT TIME WILL BE INVOICED A $25 LATE APPOINTMENT CANCELATION FEE AND SCHEDULING MEMBERSHIP APPOINTMENTS WILL BE DISABLED UNTIL THIS FEE IS PAID DURING WHICH REGULAR MEMBERSHIP CHARGES WILL STILL GO THROUGH FROM THE CARD ON FILE FOR THE MEMBERSHIP UNLESS THE CLIENT CANCELS THE MEMBERSHIP IN WHICH THE LATE APPOINTMENT CANCELATION FEE WILL STILL BE OWED IF NOT YET PAID.
Consultations -
CONSULTATIONS ARE NONREFUNDABLE. Cost of consultations can be credited towards projects and memberships.
Projects -
Project agreement offers are good for 3 months. Projects purchased at the small project flat rate of $199 will not be discounted if less than 3 hours is needed to complete the project. We do our best to screen small projects as fitting within the scope of the up to 3 hour purchased appointment, however purchasing a project at the small project flat rate of $199 acknowledges that time spent on the project past your 3 hours scheduled appointment is at the technician’s discretion due to other scheduled client appointments, and you may be charged an additional rate of $99 per hour for services past the 3 hour mark due upon project completion only in the case issues arise preventing completion of the project that were not disclosed of or foreseeable during the phone consultation. For this reason, all phone consultations are recorded. Additional project steps outside the scope of the agreed upon project steps outlined in the project agreement for projects priced beyond the $199 flat small project rate, are at the technician’s discretion, and you may be charged at the rate of $99 per hour in the case it causes the project to extend beyond the quoted estimated project time frame. All projects require a 25% deposit of the full project price due upon scheduling the project and the card used for the project deposit will be kept on file. The remaining balance for the project will be charged to the card on file upon completion of the project. PROJECT DEPOSITS ARE NONREFUNDABLE. PROJECTS COMPLETED ARE NONREFUNDABLE. STANDARD RATES ARE SUBJECT TO BEING CHARGED AT DOUBLE THE RATE FOR SERVICES OUTSIDE OUR REGULAR SERVICE BUSINESS HOURS OF MONDAY - SATURDAY 8am -6pm
Work Guarantee -
Services or work completed are warranted to be free from defective workmanship for 30 days. It is the responsibility of the client to notify Kohoutek Handy Services of workmanship defects or dissatisfaction by emailing the concern to kohoutekjoseph@gmail.com including your information, which project step is of a concern, and photos of the work done so we can compare it to the project steps listed in the project agreement for quality control within the 30 days of project completion. If it is determined there is a defect in workmanship, we will arrange for a technician to come revise the work at no additional cost to the client. Work revisals are at the company’s discretion. PROJECTS COMPLETED ARE NONREFUNDABLE.
Project Materials -
Clients are responsible for purchasing personalized, specialty, large, and permanent fixture materials for projects. Clients are responsible for insuring the foreseeable needed materials listed as their responsibility in the project agreement are at the project location and available to the technician for the scheduled project appointment. The materials listed in the project agreement are non-inclusive and the client may be responsible for purchasing more or different materials for successful project completion. Clients can request for their technician to pick up and deliver project materials that the client has already prepaid for to the project appointment up to 12 hours prior to the scheduled appointment time for an additional flat rate of $49 for materials not exceeding 100 pounds in total weight per pick up location or $99 for materials exceeding 100 pounds in total weight per pick up location within a 10 mile radius of the project site or within a 10 miles radius of the Pasadena CA Home Depot location, if the pick up location is outside the 10 miles radius of either the project or the Pasadena CA Home Depot location, there is an additional charge of $1 per mile to and from the pick up location and project location on top of original rate. IF THE PROJECT MATERIALS LISTED AS THE CLIENT’S RESPONSIBILITY IN THE PROJECT AGREEMENT ARE NOT EITHER AT THE PROJECT LOCATION AVAILABLE TO THE TECHNICIAN FOR THE PROJECT APPOINTMENT OR SCHEDULED TO BE PICKED UP BY THE TECHNICIAN 12 HOURS PRIOR TO THE PROJECT APPOINTMENT, WE MAY EITHER CHARGE DOUBLE OUR MATERIAL PICK UP RATE TO PICK UP THE MATERIALS DUE TO THE EXTRA TIME IT WILL TAKE THE TECHNICIAN TO LEAVE THE APPOINTMENT TO PICK UP THE MATERIALS, ASSUMING THE CLIENT HAS ALREADY ORDERED AND PAID FOR THE MATERIALS OR CAN HAVE THEM ORDERED AND PAID FOR ON THE SPOT FOR PICK UP, OR CHARGE THE 25% PROJECT DEPOSIT AS A LATE APPOINTMENT CANCELATION FEE AND THE PROJECT DEPOSIT WILL NEED TO BE REPURCHASED TO RESCHEDULE THE PROJECT, DEPENDING ON THE TECHNICIAN’S SCHEDULE AVAILABILITY TO SORT OUT THE INCONVENIENCE.
Waste Disposal -
Clients are responsible for having a place to square away waste produced by the project on site for the technician’s clean up process unless otherwise stated in the project agreement.. Clients can request the technician to remove of project waste from the property for an additional agreed upon fee.
Memberships -
All Kohoutek Handy Home Memberships require a card on file to stay active and failed charges will result in the ending of the membership and ability to schedule any membership appointments. Memberships can be canceled at any time with no future charges ending the ability to schedule any membership appointments. QUARTERLY, MONTHLY, AND ANNUAL MEMBERSHIP CHARGES ALREADY PROCESSED ARE NONREFUNDABLE DESPITE UASGE OF MEMBERSHIP APPOINTMENTS. Quarterly membership unused appointments do not roll over into the next quarter for all quarterly memberships. Monthly membership unused appointments to do not roll over into the next month for all monthly memberships. All memberships are ongoing and will continue to charge membership dues to the card on file unless the client cancels the membership via their account or by sending a membership cancelation request to Kohoutekjoseph@gmail.com. During Kohoutek Handy Home Membership appointments, providing any work outside the scope of regular home upkeep is at the technician’s discretion. We do not guarantee all the client’s home’s upkeep needs will be addressed in any one membership appointment, rather we guarantee we will work together with our client prioritize addressing which of the home’s upkeep needs are addressed within each appointment’s time frame.
We reserve the right to refuse or stop all services.
Changes to This Terms & Conditions -
Kohoutek Handy Services reserves the right to change pricing at any time without notice. Pricing on any services already purchased will remain the same as it was at the time of purchase. We may update our Terms & Conditions from time to time. Thus, you are advised to review our current pricing and this page periodically for any changes before purchases. We will notify you of any changes by posting the new Terms & Conditions on this page. Price changes are effective immediately after they are posted on our website. Changes to Terms & Conditions are effective immediately after they are posted to this page.
